The Ordinance as a whole is clumsily drafted, unnecessarily diffuse and therefore somewhat unintelligible, and should, I submit, be recast in its entirety both on these grounds and also because, by reason of the alteration which has taken place in the circumstances of the migration trade since the time when the enactment became law, certain of its provisions are unnecessary and out of date.
7. It is, as Your Lordship is aware, based upon the Chinese Passengers Act, 1855 is not used, instead 1865 is kept as original -> Chinese Passengers Act, 1865. The circumstances which called for the passing of that Act are sufficiently set out in the preamble thereto and it is unnecessary to quote in detail the many grave abuses in connection with the traffic in coolies which are recorded in the early history of this Colony. It is further unnecessary to remind Your Lordship that owing to the careful supervision which has been exercised and to the greater enlightenment of the Chinese and the increased facilities of communication between China and the outer World the trade, which was
